{"id":12316,"date":"2023-06-12T08:32:45","date_gmt":"2023-06-12T08:32:45","guid":{"rendered":"https:\/\/www.cryptoheretostay.com\/?p=12316"},"modified":"2023-06-12T08:32:46","modified_gmt":"2023-06-12T08:32:46","slug":"coinbase-ceo-says-crypto-industry-needs-clarity-either-from-congress-or-case-law","status":"publish","type":"post","link":"https:\/\/cryptoheretostay.com\/?p=12316","title":{"rendered":"Coinbase CEO says crypto industry needs clarity, either from Congress or case law"},"content":{"rendered":"<p> <script type=\"text\/javascript\">\r\namzn_assoc_placement = \"adunit0\";\r\namzn_assoc_tracking_id = \"totafreearti-20\";\r\namzn_assoc_ad_mode = \"search\";\r\namzn_assoc_ad_type = \"smart\";\r\namzn_assoc_marketplace = \"amazon\";\r\namzn_assoc_region = \"US\";\r\namzn_assoc_default_search_phrase = \"crypto\";\r\namzn_assoc_default_category = \"All\";\r\namzn_assoc_search_bar = \"false\";\r\namzn_assoc_title = \"\";\r\namzn_assoc_rows =\"1\";\r\n<\/script>\r\n<script src=\"\/\/z-na.amazon-adsystem.com\/widgets\/onejs?MarketPlace=US\"><\/script><br \/>\n <\/p>\n<p>The U.S. crypto industry needs regulatory clarity, which can only come from Congress or through case law, Coinbase CEO Brian Armstrong told <em>The Wall Street Journal<\/em>.<\/p>\n<p>Armstrong said there\u2019s an ongoing power struggle between the Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC) and Coinbase has been \u201ccaught in the middle\u201d of this turf war between the agencies.<\/p>\n<p>The SEC and CFTC have contradicted each other in the past \u2014 the CFTC has claimed certain assets like Ethereum to be commodities while the SEC has called them securities.<\/p>\n<p>Since the two agencies have not been able to come to an agreement on the status of cryptocurrencies as securities or commodities, we need clarity, Amstrong said. And for this clarity, Congress has to step in and frame legislation, he said.<\/p>\n<p>But until we have legislation, the industry will depend on case laws that will emerge out of lawsuits like the one filed by the SEC against Coinbase last week, he said.<\/p>\n<h2>Armstrong says Coinbase has only listed crypto commodities<\/h2>\n<p>In its lawsuit, the SEC claims that thirteen of the assets listed on Coinbase are securities. But Coinbase rejects the assertions.<\/p>\n<p>Armstrong said that Coinbase carefully reviews tokens before listing and rejects 90% of reviewed assets. The listing process involves \u201crigorous analysis,\u201d and there\u2019s a \u201cstack of paper\u201d for every asset listed on the exchange, he said. And he \u201cfeels\u201d that the tokens listed on Coinbase are commodities and not securities.<\/p>\n<p>According to Armstrong, the exchange constantly asked the SEC for guidance \u2014 asked them if certain tokens were \u201cokay\u201d to be listed. But since Coinbase never received any feedback from the SEC, it had to create its own process.<\/p>\n<p>Coinbase has a digital asset listing committee, of which Armstrong is not a member, that reviews tokens for listing. The committee considers several factors before approving an asset for listing, including a legal analysis of whether they are commodities or securities, Armstrong said.<\/p>\n<p>Armstrong added that Coinbase shared its framework for differentiating between crypto securities and commodities with the SEC before it went public.
