{"id":10954,"date":"2023-03-17T12:02:41","date_gmt":"2023-03-17T12:02:41","guid":{"rendered":"https:\/\/cryptoheretostay.com\/?p=10954"},"modified":"2023-03-17T12:02:42","modified_gmt":"2023-03-17T12:02:42","slug":"lightning-labs-and-tari-agree-to-convert-restraining-order-in-trademark-suit","status":"publish","type":"post","link":"https:\/\/cryptoheretostay.com\/?p=10954","title":{"rendered":"Lightning Labs and Tari agree to convert restraining order in trademark suit"},"content":{"rendered":"<script type=\"text\/javascript\">\r\namzn_assoc_placement = \"adunit0\";\r\namzn_assoc_tracking_id = \"totafreearti-20\";\r\namzn_assoc_ad_mode = \"search\";\r\namzn_assoc_ad_type = \"smart\";\r\namzn_assoc_marketplace = \"amazon\";\r\namzn_assoc_region = \"US\";\r\namzn_assoc_default_search_phrase = \"crypto\";\r\namzn_assoc_default_category = \"All\";\r\namzn_assoc_search_bar = \"false\";\r\namzn_assoc_title = \"\";\r\namzn_assoc_rows =\"1\";\r\n<\/script>\r\n<script src=\"\/\/z-na.amazon-adsystem.com\/widgets\/onejs?MarketPlace=US\"><\/script>\n<p>Bitcoin (BTC) software firm Lightning Labs and blockchain startup Tari Labs have agreed to convert a court-ordered temporary restraining order that halts the development of Lightning\u2019s Taro protocol.<\/p>\n<p>In a March 15 filing, lawyers for both Lightning and Tari proposed converting the restraining order to a preliminary injunction \u2014 a temporary order that prevents a party from undertaking certain actions.<\/p>\n<p>The order\u2019s conversion to a preliminary injunction would stop the development of the protocol until a court decision is reached.<\/p>\n<p>The two firms agreed that Lightning would still not make updates to the Taro protocol, merge internal updates with the protocol\u2019s public-facing open-source code, and could not announce or otherwise launch \u201cthe next stage or \u2018milestone\u2019 of the TARO protocol.\u201c<\/p>\n<p>Lightning was permitted, however, to respond to communications from non-Lightning developers and users if it does not use those communications to further Taro\u2019s development.<\/p>\n<p>It could also reference Taro as the \u201cprior name of the protocol\u201d for announcements pertaining to changing the protocol\u2019s name \u2014 as long as it was \u201cnot confusingly similar\u201d to Taro or Tari.<\/p>\n<p>The temporary restraining order was issued on March 13 by California District Court Judge William Orrick after Tari Labs said the name \u201cTaro\u201d infringed on its trademark rights as it was too similar to its own protocol named \u201cTari\u201d \u2014 a registered trademark in the United States.<\/p>\n<p>As a result, Lightning Labs has been unable to make updates to or regarding the Taro protocol.<\/p>\n<p>Tari Labs first filed a complaint for trademark infringement against Lightning Labs on Dec. 8, alleging both firms \u201ccompete in the same digital blockchain ecosystem\u201d and provide similar, \u201cin some cases identical,\u201d services.<\/p>\n<p>Both firms also \u201cmarket to similar developers and users, and appear on the same blockchain platforms,\u201d according to Tari.<\/p>\n<p><strong><em>Related:<\/em> <\/strong><strong><em>DeFi on Bitcoin is possible with this new Layer 2: AMA with Mintlayer<\/em><\/strong><\/p>\n<p>News of the restraining order prompted a backlash on Twitter. Tari Labs co-founder, Riccardo Spagni, defended the lawsuit, arguing in a March 15 tweet that the letters \u201cI\u201d and \u201cO\u201d are close enough together on a computer keyboard to cause confusion and that Tari offered to fund Taro\u2019s rebrand a year ago.<\/p>\n<p lang=\"en\" dir=\"ltr\">On the contrary &#8211; if you don\u2019t defend a trademark you literally lose it. That said, it&#8217;s hard to call something &#8220;frivolous&#8221; when a judge issues a temporary restraining order in your favor.<\/p>\n<p>\u2014 Naveen  (,) (@NaveenSpark) March 16, 2023<\/p>\n<p>Lightning Labs develops software for the Lightning Network, a layer 2 solution for the Bitcoin blockchain, which allows for cheaper and faster transactions than those executed on the base layer.<\/p>\n<p>Its Taro protocol is an ambitious project announced on April 5, 2022, amid a $70 million funding round.
